1. About These Terms
This website, www.kedronwavellsnooker.com.au, is operated by Kedron Wavell Snooker Inc. (ABN 27 340 749 812), an incorporated association and private members’ snooker and billiards club based in Chermside, Queensland, Australia (“the Club”, “we”, “us”).
These Terms of Service apply to your use of our website, including our members-only online community and our visitor booking system. By using the website, creating an account, or making a booking, you agree to these terms. If you don’t agree with them, please don’t use the site.
These terms cover the website only. Club membership itself is governed by the documents you agree to when you join: the Club’s Constitution (under the Associations Incorporation Act 1981 (Qld)), the Membership Terms and Conditions, and the Table Booking System Terms. If there’s any inconsistency between these website terms and those documents, those documents prevail for membership, club conduct and table booking matters.
2. Eligibility and Accounts
You must be at least 18 years old to use this website, create an account, or make a booking.
Access to the members’ area is available to current Club members and other people we approve. When you register, you agree to provide accurate and current information and to keep it up to date. You’re responsible for keeping your login details secure and for all activity that happens under your account. If you believe your account has been accessed without your permission, tell us straight away at secretary@kedronwavellsnooker.com.au.
Access to the members’ area is a benefit of membership. If your membership ends or lapses, your access to the members’ area may be suspended or removed.
3. Table Bookings and Visitor Fees
Table bookings are made through the members’ area and are available to current Platinum Members. Bookings are governed by the Club’s Table Booking System Terms and Conditions, which members agree to when joining; those terms cover booking limits, fair use, and the cancellation policy (bookings should be rescheduled or cancelled at least 1 hour before the booked time, and a cancellation fee of $10 per hour booked may apply where they’re not).
Members bringing visitors can pay the applicable visitor fee through the booking system during the booking process, or have it invoiced, as set out in the Membership Terms and Conditions. All fees are shown in Australian dollars and include GST where applicable. Card payments are processed securely by Stripe; we don’t see or store your card details.
Nothing in this section limits your rights under the Australian Consumer Law, including your rights to a remedy if a service isn’t provided as described. We do our best to keep pricing and booking information accurate, but we may correct errors and update fees from time to time. Fee changes won’t affect bookings you’ve already paid for.
4. Community Rules
The members’ area is a private community and we want it to stay friendly. Members must also follow the Club’s general rules and regulations as set out in the Members Guide. When you post, comment, message or upload photos, you agree that you won’t: harass, intimidate, bully or discriminate against anyone; post content that is unlawful, defamatory, obscene or offensive; post other people’s personal information without their consent; upload photos of people who haven’t agreed to appear in them; use the community for commercial promotion, spam or solicitation without our permission; impersonate any person; or upload viruses or any malicious code.
We may remove any content that breaches these rules, and we may suspend or remove community access for members who repeatedly or seriously breach them. Where practical, we’ll let you know and give you a chance to respond first.
5. Your Content
You own the content you post in the members’ area, including your photos. By posting, you give the Club a non-exclusive, royalty-free licence to host, display and share that content within the members’ area for as long as it remains posted. We won’t use your content outside the members’ area (for example, on our public website or social media) without asking you first.
You can delete your own content at any time, and you can ask us to delete your profile and content if your membership ends. You’re responsible for the content you post, and you confirm that you have the right to post it.
6. Our Content
The website’s design, text, images and branding belong to the Club or are used with permission. You’re welcome to view and share links to our public pages, but please don’t copy or republish our content, or content posted by other members, without permission.
7. Acceptable Use of the Website
You agree not to use the website for any unlawful purpose, attempt to gain unauthorised access to any part of the site or other members’ accounts, interfere with the site’s security features, or collect other users’ personal information via scraping or any automated means.
8. Privacy
Your personal information is handled in accordance with our Privacy Policy, which explains what we collect, how we use it, and your rights to access and correct it.
9. Availability and Changes to the Website
We aim to keep the website available and working well, but we can’t promise it will always be uninterrupted or error-free; occasionally we’ll need to take it down for maintenance or updates. We may change, add to, or discontinue features of the website (including the members’ area) from time to time. Where a change significantly affects members, we’ll aim to give reasonable notice.
10. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement.
Subject to that, and to the extent permitted by law: we’re not liable for indirect or consequential loss arising from your use of the website; we’re not responsible for content posted by other members, or for third-party websites we link to; and where liability can be limited, our liability is limited to resupplying the relevant service or paying the cost of having it resupplied.
11. Suspension and Termination
You can stop using the website, or ask us to close your account, at any time. We may suspend or terminate your account if you breach these terms, if your membership ends, or if it’s necessary to protect the Club, its members or the website. For serious breaches (such as unlawful conduct or harassment), we may suspend access immediately. Sections 5, 6 and 10 continue to apply after your account is closed.
12. Changes to These Terms
We may update these terms from time to time. When we do, we’ll update the “Last updated” date at the top of this page, and for significant changes we’ll notify members through the members’ area or by email. Your continued use of the website after changes take effect means you accept the updated terms.
13. Governing Law
These terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland.
